1. Agreement
These Terms of Service ("Terms") govern your use of pixelforgeai.pro and your engagement with PixelForge Inc. ("PixelForge", "we", "us"), a generative-AI visual production and finishing studio at 52 Sudbury Street, Suite 104, Toronto, ON M6J 3S4, Canada. BN 861573920 RC0001. By using our website or engaging our services, you agree to these Terms. Project-specific agreements supplement and prevail over these Terms where they conflict.
2. Brand and domain clarifications
The domain pixelforgeai.pro and the .pro TLD are used for branding only. "Pixel" refers to image pixels and visual content — not the Google Pixel product or pixel-art-only services. "Forge" means crafting and finishing imagery with skill in a creative studio context — not metal forging, not software code repositories (e.g., "Git forge"), and not forgery or counterfeiting.
PixelForge is a professional creative services firm delivering generative-AI visual work. We are not a self-serve image-generator application, not a SaaS subscription product, not a stock-image marketplace, not a deepfake service, and not an AI-art course or training programme.
3. Services description
We provide generative-AI visual services including image generation, style training, editing, retouching, rendering, concepting and illustration — produced with human art direction and review for client organizations. Services are delivered as studio projects, per-deliverable engagements or retainers quoted in Canadian dollars (CAD).
Studio services include briefing and scoping, moodboard alignment, diffusion-model generation, composite builds, retouch and upscale, and delivery of final files with usage-rights documentation. We do not sell software licences, API access, preset packs or training courses as our primary offering.
4. AI outputs and human review
Images are created using generative AI tools including text-to-image and image-to-image diffusion models and are checked by people before delivery. AI outputs can contain errors, artefacts or unintended similarities and always require human review. We do not guarantee specific aesthetic results, commercial performance or freedom from all artefacts. Revision rounds are defined per project scope.
5. Usage rights and licensing
Upon full payment, clients receive the usage rights defined in the project agreement — typically a commercial licence for agreed channels, territories and duration. Unless otherwise stated, PixelForge retains no right to use delivered imagery in our marketing without separate written consent. We retain rights to our methodologies, workflows and any pre-existing studio tools.
Custom style-training models built from client materials are governed by project NDA and licensing terms. Sublicensing, resale as stock imagery, or use outside agreed channels requires written approval.
6. Prohibited uses and content
Clients may not use deliverables for unlawful purposes, explicit content distribution where not scoped, misinformation presented as photojournalism, or deepfake / likeness misuse. We do not knowingly create images that infringe third-party copyright or trademarks, depict real identifiable people without consent, or present synthetic images as genuine photographs where that would mislead.
We do not produce deepfakes, face-swap content, or imagery designed to deceive about real-world events. Requests for such content will be refused. We may terminate engagements if a client repeatedly requests prohibited content or uses deliverables in ways that expose PixelForge to legal or reputational risk.
7. Client responsibilities
Clients are responsible for: providing accurate briefs and lawful reference materials; final usage clearance including trademark, copyright and publicity rights; compliance with advertising standards and platform policies for AI-generated imagery; and appropriate disclosure of synthetic content where required by law or platform rules.
Our licensing documentation and studio guidance are not legal advice on intellectual property. Clients should consult qualified counsel for complex rights questions.
8. Results disclaimer
Any samples, portfolio descriptions or illustrative project narratives on our website are examples of our craft and are not promises of specific results. Commercial outcomes depend on many factors outside our control. We make no warranty of merchantability or fitness for a particular purpose beyond redelivery or correction within agreed revision rounds for demonstrable non-conformance to written specifications.
Generative-AI image generation is probabilistic. Similar briefs may produce different aesthetic outcomes across projects. We do not warrant that outputs will be free from all artefacts at raw generation stage — finishing and human review are part of the service.
9. Payment and CAD pricing
Quotes are in CAD unless otherwise stated. Invoices are due per agreed terms. Late payment may suspend deliverable release. Deposits on projects above defined thresholds are non-refundable once generation work commences, as stated in project agreements.
Applicable taxes (HST/GST/PST as required) are added to invoices per Ontario and Canadian tax rules. Currency conversion for international clients is the client's responsibility unless a CAD invoice is explicitly agreed.
10. Confidentiality
We treat client briefs, unreleased imagery and reference materials as confidential. Clients agree not to disclose our proprietary workflows, prompt libraries or pricing structures without consent.
Mutual confidentiality survives termination of a project for unreleased materials and non-public methodologies, subject to any NDA terms in the project agreement.
11. Revision rounds and deliverable acceptance
Revision rounds are defined in each project agreement. Requests outside agreed scope — new concepts, additional deliverables, or material brief changes — are quoted separately. Client feedback must be consolidated per round; fragmented micro-revisions across multiple channels may be treated as a single round at our discretion. Deliverables are deemed accepted if no written rejection listing specific non-conformance to agreed specifications is received within ten business days of delivery, unless a different period is stated in the project agreement.
Force majeure events — including widespread service outages at essential AI tool vendors — may extend turnaround timelines. We will notify clients promptly and propose revised schedules. Deposits remain governed by the signed project agreement during delay events.
12. Limitation of liability
To the maximum extent permitted by Ontario law, PixelForge's total liability for any claim arising from services or website use is limited to fees paid for the specific project giving rise to the claim. We are not liable for indirect, consequential or punitive damages, lost profits, or client misuse of deliverables.
13. Indemnification
Clients indemnify PixelForge against claims arising from client's unlawful use of deliverables, breach of these Terms, or provision of unlawful reference materials — except where caused by our knowing infringement or gross negligence.
14. Website use
Website content is for general information. You may not scrape, reverse-engineer, or misuse our site; attempt unauthorized access; or misrepresent affiliation with PixelForge.
15. Privacy
Personal information is handled per our Privacy Policy and PIPEDA. Contact forms require explicit consent for enquiry processing.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of Ontario courts, with parties first attempting good-faith resolution via direct contact at [email protected].
Nothing in these Terms excludes rights that cannot be waived under applicable consumer protection legislation where such legislation applies to your engagement.
17. Changes
We may update these Terms. The "Last updated" date will change. Material changes are posted on this page. Active project agreements continue under their signed terms.
